Understanding UAE Property Laws: Can a Landlord Refuse to Renew a Lease After It Was Previously Declined?

In the world of UAE property, it’s not uncommon for landlords to offer lease renewals well before the expiry date. This is usually done as a courtesy, enabling tenants to plan for their future living arrangements. But what happens when a tenant declines a renewal offer, only to change their mind later on?

One Dubai tenant found themselves in this predicament. They declined their landlord’s offer to renew their lease for another year with a 10% rent increase, citing other plans in an email response. However, their situation changed, and they decided they now wanted to stay on under the new terms. Unfortunately, the landlord was not responding to their messages, leading to the question of whether they could now deny the tenant’s request.

According to UAE property laws, a tenant is not obligated to inform their landlord of their decision not to renew. Once signed, a tenancy contract has specific start and end dates, and either party can choose not to renew at the end of the term. However, it’s considered good practice to notify the landlord if circumstances change, so they can plan for potential vacancies or any necessary maintenance work.

In this case, there is no clear answer as to whether the landlord can refuse to renew the lease after it was previously declined. The law is silent on the matter, leaving it up to the parties involved to communicate and work towards a resolution. It’s recommended that the tenant continues to try and reach out to the landlord to discuss their situation and hopefully come to an agreement that works for both parties.
